Understanding Guardian Background Clearance Requirements for Third-Party Administrative Support

The HCSB's Guidance


According to the HCSB:


  • Individuals performing administrative functions without contact with clients, prospective clients, or confidential client information generally do not require a Guardian criminal background clearance unless they are otherwise required by statute (such as owners, CEOs, designees, or affiliated Home Care Aides).


  • However, individuals employed by a third-party vendor who perform services such as:

- Scheduling

- Recruiting

- Client intake

- Customer service

- Payroll support

- Bookkeeping

- Marketing

- Other administrative functions


must obtain a Guardian criminal background clearance if their duties involve any contact with clients, prospective clients, or confidential client information.


The HCSB further clarified that this determination applies regardless of whether the individual works inside California, outside California, or remotely.


Why Scheduling Raises Compliance Concerns


Scheduling is often viewed as a purely administrative task.


In reality, schedulers typically access:

  • Client names and addresses

  • Telephone numbers

  • Care plans

  • Service schedules

  • Caregiver assignments

  • Emergency contacts

  • Health-related information

  • Client preferences

  • Employee availability

  • Personnel information


Schedulers also routinely communicate with:

  • Clients

  • Family members

  • Caregivers

  • Prospective clients


Because these responsibilities frequently involve confidential client information and direct client contact, scheduling personnel generally fall within the categories identified by the HCSB as requiring Guardian background clearance.


The Same Principle Applies to Other Administrative Roles


The same analysis should be applied whenever a third-party individual has access to confidential information.


Examples include:

California law does not specifically prohibit the use of offshore administrative personnel.


However, the HCSB confirmed that the determining factor is access to confidential client information and client contact—not geographic location.

Before engaging a remote administrative service, consider the following:

  • Will the individual access client records?

  • Will they answer calls from clients?

  • Will they communicate with caregivers?

  • Will they schedule or reschedule client visits?

  • Will they access personnel files?

  • Will they handle protected or confidential information?

  • Have they completed a California Guardian background clearance if required?

  • Does your Business Associate Agreement and confidentiality documentation adequately protect client information?
